(COLORADO SPRINGS) — A lawsuit the 2C Road Improvement ballot question removed from the November ballot has been dismissed.
The issue in question, Ballot Issue 2C, would extend the .57% sales tax for an additional 10 years, until December 2035. The sales tax, which collects 5.7 cents for every $10, was originally approved in 2015 and renewed in 2019. It is set to expire on Dec. 31, 2025. The funds collected from the sales tax are used primarily for road improvements like paving, pothole repair, and other maintenance of Colorado Springs’ roads.
Doug Bruce, the author of Colorado’s Taxpayer’s Bill of Rights (TABOR), filed the lawsuit against the City of Colorado Springs over the 2C measure.
Bruce claimed the ballot question’s language violated a dozen TABOR requirements, but a judge disagreed at a hearing on Oct. 4, citing a State Supreme Court ruling against Bruce, when he filed a similar lawsuit against a different measure back in 2006.
The judge’s ruling could still be appealed.
