Woman sues JetBlue after suffering injury from ‘dangerously cold’ ice cream sandwich

The alleged incident occurred on a Paris-bound JetBlue flight that departed from New York's JFK Airport on August 20.

A New Jersey woman has sued JetBlue for serving her a “frozen solid” ice cream sandwich that caused her to break one of her front teeth.

Kiara Quinonez claimed that during an August 20 flight from New York’s JFK Airport to Charles De Gaulle Airport in Paris, France, the flight crew gave her a Nightingale brand strawberry shortcake ice cream sandwich.

The lawsuit alleges that the sweet treat was “at a temperature below what is reasonable or safe for consumption” and Quinonez was not warned “of the dangerously cold temperature and solid state of the ice cream sandwich served to her.” ‘

The lawsuit claims Quinonez suffered “serious and permanent bodily harm” from biting into the ice cream sandwich, adding that she continues to incur costs for ongoing treatment.

She is represented by Christopher S. Fraser of law firm Dweck, who demanded a jury trial to determine how much JetBlue must pay for the alleged damages.

Quinonez reportedly suffered a root fracture to tooth number 10 – also known as the upper left lateral incisor – which is located right next to the left front tooth.

According to the lawsuit, she needed “immediate” medical treatment when she landed in Paris.

She claimed her injury required her to have the tooth extracted, after which she received an implant and other additional treatments.

“As a direct and proximate result of the actions of Defendant, its agents and/or employees as described above, Plaintiff has suffered serious and permanent physical injuries, suffered pain, suffering and mental anguish, and incurred expenses for medical care and treatment, which all continue,” the lawsuit alleged.

The complaint was filed in New York’s Eastern District Court on October 22, months after the alleged incident occurred.

DailyMail.com reached out to JetBlue for comment.

This comes months after another JetBlue passenger filed a lawsuit alleging severe burns she suffered from a spilled cup of hot tea.

Tahjana Lewis, a Connecticut woman, traveled with her 5-year-old daughter on a flight from Orlando, Florida, to Hartford, Connecticut, in May, according to the June complaint.

Lewis claimed that when a fellow passenger was served the drink by a flight attendant, the cup fell, spilling the tea all over her.

According to the lawsuit, Lewis now has severe burns to her upper chest, legs, buttocks and right arm, some of which will be permanent.

The flight crew failed to “properly administer first aid” after the spill, the lawsuit said.

Lewis sought more than $1.5 million in damages given the severity of her injuries and the impact they had on her ability to work at work, the lawsuit said.

A similar lawsuit against JetBlue was filed in 2017 by a 25-year-old woman, who, like Lewis, claimed she suffered severe second- and third-degree burns to her butt after allegedly being burned by excruciatingly hot tea during a flight.

Michelle Lavin claimed the incident occurred over Labor Day weekend in 2014, when she was on her way to visit her older sister for a weekend getaway during a five-hour, 40-minute flight from New York to Las Vegas.
